Smart Phone Without Data Plan

Can I use an unlocked smart phone and activate it on Verizon wireless without the data plan?
I bought the unlock Samsung Omnia, now is is possible to activate that phone online with my esn without getting a mandatory data plan.
The second you put in the ESN it will know its a smart phone and require you get the data plan. Theres not really a way around that.
