Can i buy a Sidekick LX from eBay and use it without the data plan?

I am so confused about what’s going on about the whole “required data plans for every single smart phone, starting june 3rd 2009″ from tmobile and they even told me that even if you buy a second hand phone, you still have to get the data plan. But my friend doesn’t have the data plan and she is using her sidekick 2008 perfectly fine like a regular phone, without internet and email of course.
So can anyone clear this whole thing up for me. I really want a sidekick lx -2007 but i dont want to waste my money buying it and not being able to use it at all. I just need to use it as a texting and calling phone, cause i like the keyboard. so please clear this whole thing up for me, so i know if i should get it or not.

She probably has an older plan. Usually what happens is that once you are on an existing contract the wireless company is not allowed to change your existing contract. IF, on the other hand, the wireless company would change your existing contract before the contract expires the person who owns the account could terminate their contract with the wireless company completely without an early termination fee.

So to summarize: She probably has an older plan and If you get a new contract with T-mobile then yes you would HAVE to pay for a data plan as well.

If you have an older contract that doesn’t have a data plan you maybe able to squeak through those cracks as well… but really what’s the point of that since a sidekick is known as a smartphone. Using a sidekick without all the little knick-knacks and goodies is like driving a ferrari to the corner store. Just find a cell phone through T-mobile that would have qwerty keypads without it being smartphone. I must say though that qwerty keypads are used mainly for smartphones though so that people can text and use the internet a la a computer, which is what a smartphone is; a mini computer.
